1Who we are

Penalty Picker is an independent mobile application published by The Playmakers. By installing, opening, or using Penalty Picker, you agree to these Terms of Service. If you do not agree, please do not use the app. Our contact email is fritz.playmaker@gmail.com.

2What Penalty Picker does

Penalty Picker is a football prediction game. You predict where penalty kicks go — in live matches, daily puzzles, and a practice pool of historic penalties — and earn a Penalty IQ score based on your skill. Live match data is sourced from publicly available feeds.

3Entertainment, not gambling

Penalty Picker is a free game of skill and prediction provided for entertainment. It involves no real-money wagering, no payouts, and no purchase of chances to win. Your Penalty IQ score, streaks, and cards have no monetary value and cannot be exchanged for anything of value.

4Predictions are not guarantees

Nothing in the app is a forecast you should rely on for any real-world decision, including betting. Outcomes shown reflect public match data and your in-game picks. We make no representation that any prediction reflects what will or did happen in a real match.

5Your account (optional)

You can use Penalty Picker without an account. Signing in with Google or Apple is optional and only unlocks cloud sync of your progress across devices — see our Privacy Policy. You are responsible for keeping your Google or Apple credentials secure. We rely on Google and Apple's authentication; we never see or store your password.

6Acceptable use

You agree to use Penalty Picker only for its intended purpose. Specifically, you will not:

• Reverse engineer, decompile, or modify the app or its server-side APIs except as permitted by mandatory law.
• Use automated tools (bots, scripts) to manipulate scores, streaks, or leaderboards.
• Attempt to gain unauthorised access to any non-public Penalty Picker system or infrastructure.
• Use the app to harass, threaten, or deceive other users.
• Use the app in violation of any applicable Ghanaian or international law.

If you breach these rules we may, at our discretion and without notice, suspend or terminate your access — including by blocking the anonymous device identifier we issued to your install, or by disabling a signed-in account.

7Match data & third parties

Live and historical football data is sourced from publicly available feeds and may contain delays or errors. We do not warrant its accuracy and are not affiliated with any league, club, competition, or data provider. Where the app uses third-party services (Google, Apple, Firebase), your use of those is governed by their own terms.

8Intellectual property

Penalty Picker, its name, logo, app design, source code, and content are the intellectual property of The Playmakers. You receive a limited, non-exclusive, non-transferable, revocable licence to install and use the app for personal, non-commercial use. All rights not expressly granted are reserved.

9No warranty

Penalty Picker is provided "as is" and "as available", without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantee that the app will be uninterrupted or error-free, or that match data will be accurate. To the maximum extent permitted by law, you use the app at your own risk.

10Limitation of liability

To the maximum extent permitted by law, The Playmakers and its officers, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or use, arising out of or related to your use of Penalty Picker. Our total aggregate liability for any claim is limited to the greater of (a) the amount you paid Penalty Picker in the 12 months before the claim (which, since the app is free, will be zero) or (b) USD 50.

11Indemnity

You agree to indemnify and hold harmless The Playmakers and its officers, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the app, or your violation of any law or third-party right.

12Changes to the app or these Terms

We may update Penalty Picker and these Terms from time to time. Material changes will be noted in the app and the "Last updated" date above will change. Continued use after a change means you accept the updated Terms. If you do not agree, stop using the app and uninstall it.

13Termination

You may stop using Penalty Picker at any time by uninstalling it and (if you signed in) signing out. We may suspend or terminate your access at our discretion if you breach these Terms.

14Governing law and disputes

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the courts of Accra, Ghana — except where mandatory consumer-protection law in your country grants you a different forum, in which case that mandatory right applies.

15Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be replaced by an enforceable one that most closely matches the original intent.
